About these terms
GoSouq (gosouq.me, the "Service") is operated by Codecraft Innovations W.L.L, Commercial Registration No. 179283-1, Kingdom of Bahrain ("GoSouq", "we", "us" or "our"). These terms of use (the "Terms") apply to everyone who visits or uses GoSouq ("you").
By using GoSouq you agree to these Terms and to our privacy policy. If you use GoSouq on behalf of a showroom or another business, you confirm that you have the authority to accept these Terms for it. If you do not agree, do not use GoSouq.
Part A applies to everyone. Part B, the store terms, also applies to every showroom that lists on GoSouq.
Definitions
Visitor: anyone who browses GoSouq. Visitors do not need an account.
Showroom: a vehicle business that lists vehicles on GoSouq through the GoSouq console, together with each person it invites as a user.
Listing: a vehicle page published by a showroom, with its photos, specs, price and contact details.
Console: the private area where showrooms manage their listings, storefront and account.
Paid services: optional services a showroom pays for, such as access to connect its own domain.
Part A. GoSouq is a showcase, not a seller
GoSouq shows vehicles listed by showrooms. We are not the seller, we are not a party to any sale or agreement between you and a showroom, and we do not take payments for vehicles. Any deal for a vehicle, including its price, condition, papers, delivery and warranty, is between you and the showroom.
We do not inspect vehicles or verify listings, and we do not give financial, legal or technical advice about any vehicle. Always see the vehicle, check its documents and confirm the details and price with the showroom before you pay anything.
Listings
Each showroom is responsible for its listings, including the description, price, availability and the right to use its photos. Listings can change or be removed at any time, and a vehicle shown may already be sold.
Prices are shown in the listing currency as given by the showroom. Some listings show Price on request.
Some listing details are filled in automatically from the showroom's own posts, and some text may be translated automatically. Mistakes can happen, so confirm any detail that matters to you with the showroom.
Contacting showrooms
Calls and WhatsApp messages go directly to the showroom. GoSouq does not see or keep the content of your calls or messages. Please be respectful. GoSouq is not responsible for what a showroom says, offers or does.
Featured placements
Showrooms can promote vehicles. Promoted placements are always marked as Featured.
Acceptable use
Use GoSouq only for lawful purposes. You must not collect listings, showroom details or other content in bulk by scraping, bots or any other automated means, except search engine and AI crawlers that follow our robots.txt.
You must not copy, republish or sell GoSouq content for commercial use without our written permission.
You must not interfere with GoSouq, its security or its checks against abuse, or try to reach parts of the service you are not allowed to use.
You must not use GoSouq to mislead, harass, spam or defraud anyone, or to publish unlawful content.
Content and trademarks
The GoSouq name, logo, design and software belong to Codecraft Innovations W.L.L. These Terms do not give you any right to use them without our written permission.
Vehicle photos and descriptions belong to the showrooms or are licensed to GoSouq for display.
Vehicle brand names and make logos are used only to describe the vehicles listed. The logos come from GoSouq's own logo library, collected from reliable public brand logo sources, and do not mean that any brand endorses GoSouq or a showroom.
Availability and changes to the service
GoSouq may sometimes be unavailable or contain errors, and we do not promise uninterrupted service. We may change, pause or stop any part of it, for example to fix problems, keep it secure or meet legal requirements.
Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSOUQ IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT.
WE DO NOT WARRANT THE ACCURACY OF ANY LISTING, THE CONDITION, HISTORY OR LEGAL STATUS OF ANY VEHICLE, OR THE CONDUCT OF ANY SHOWROOM OR VISITOR.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODECRAFT INNOVATIONS W.L.L AND ITS DIRECTORS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS, ARISING FROM YOUR USE OF GOSOUQ OR FROM ANY DEAL WITH A SHOWROOM.
OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID GOSOUQ IN THE 12 MONTHS BEFORE THE CLAIM. IF YOU PAID NOTHING, IT IS LIMITED TO 50 BAHRAINI DINARS.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the mandatory laws of the Kingdom of Bahrain.
Indemnity
You agree to indemnify and hold harmless Codecraft Innovations W.L.L and its directors, employees and agents against any claims, losses, damages and costs, including reasonable legal fees, arising from your breach of these Terms, your violation of any law or third party right, or, for showrooms, the content you publish on GoSouq.
Part B. Store terms for showrooms
This part applies to every showroom that lists on GoSouq, in addition to Part A. A showroom accepts these store terms when it starts using the GoSouq console. If Part A and Part B differ, Part B applies to the showroom.
Eligibility and accounts
A showroom must be a lawfully operating vehicle business in a country GoSouq serves. Each showroom user must be at least 18 years old.
The showroom is responsible for its users, for keeping their sign in details, codes and devices secure, and for everything done under its account. Tell us at once at support@gosouq.me if you think an account has been misused.
GoSouq staff may sign in to a showroom's account to give support. Each such session needs a recorded reason, is limited in time and is logged.
Accuracy and rights
The showroom is responsible for its listings, including the description, price and availability, and keeps them accurate and up to date. Listings must describe real vehicles that the showroom offers and must follow the laws that apply to the showroom, including consumer protection and advertising rules.
The showroom confirms it has the right to use every photo, logo and text it publishes on GoSouq or that GoSouq imports for it.
Licence to GoSouq
The showroom gives GoSouq a non exclusive, royalty free licence to show its listings, photos, name and logo on GoSouq and on the showroom's own pages, and to use them in share cards, posters, QR codes and other marketing material for the showroom and for GoSouq, for as long as the content is listed.
Instagram import
When a showroom submits or authorizes an Instagram handle, it confirms that it controls that public Professional account and authorizes GoSouq to read the account's public posts through the official Instagram API (Business Discovery), under the Meta Platform Terms, to create and update its listings.
GoSouq records this authorization. The showroom can withdraw it at any time by contacting GoSouq, and the import then stops.
Listings created from an import are reviewed by GoSouq before they go live, unless GoSouq allows the showroom's imports to publish directly.
Showroom username
The showroom username is part of the showroom's GoSouq address. The showroom can change it within the limits shown in the console.
GoSouq may change or take back a username, for example in a trademark dispute or when a name is misleading. When GoSouq changes a username, the old address keeps leading to the new one. When GoSouq takes a username back, the old address stops leading to the showroom.
Custom domains
A showroom can connect its own domain as a paid service. The showroom owns the domain and is responsible for keeping it registered and renewed and its DNS records correct.
Access to a custom domain is granted for 12 months at a time. Before it ends, we remind the showroom by email. If it is not renewed, the domain stays live for a short grace period and is then suspended. The showroom's settings are kept, so access can be renewed later.
GoSouq may suspend a domain that stops working, fails its checks or is used for abuse. Pages on the showroom's domain always show the Powered by GoSouq footer, which links to GoSouq's privacy policy.
Fees, invoices and refunds
Paid services are offered at the price in our offer or invoice for the showroom's country, for the term stated. Prices can change, but a change applies only to new terms, never to a term already paid.
Fees are paid against an invoice issued by Codecraft Innovations W.L.L, in the currency shown on it, and are exclusive of any taxes that may apply. GoSouq is not currently registered for VAT, so no VAT is charged.
If GoSouq cannot get a paid custom domain working within 14 days of payment, we refund the fee in full. Once the showroom's site is live on its domain, fees are final and non refundable, except where the law requires a refund.
GoSouq may also grant paid services free of charge. A free grant ends at the end of its term unless it is renewed.
Data on the showroom's domain
On the showroom's own domain, GoSouq serves the pages and sets an anonymous device cookie for that domain, separate from the one on gosouq.me. For that traffic GoSouq acts as the showroom's processor: it uses the data only to run and measure the showroom's pages, keeps it secure and deletes it as described in the privacy policy.
As processor, GoSouq processes that data only as set out in these store terms, keeps it confidential, uses only the service providers named in the privacy policy, helps the showroom answer requests from the people concerned, tells the showroom without undue delay about a personal data breach that affects it, and deletes the data when the showroom leaves GoSouq. The showroom is responsible for having a lawful basis for that processing and for its own privacy notice.
Suspension
GoSouq may unlist a vehicle, or unlist or suspend a showroom, that breaks these terms, publishes misleading or unlawful content, or puts visitors or the service at risk. Where possible GoSouq tells the showroom by email and explains what to fix.
Paid services of a suspended showroom may be suspended too. When the suspension is caused by a breach of these terms, fees for that term are not refunded.
Leaving GoSouq
A showroom can ask GoSouq at any time for a copy of its data or to delete its account. We confirm the request with the account email before we act on it.
A deleted account can be restored for 30 days. After that its personal data and media are removed, and backups are overwritten within 90 days. We keep invoices and payment records, security logs, total statistics and username history as records.
Suspension and termination
You can stop using GoSouq at any time. A showroom can also ask us to delete its account as described above.
We may suspend or end your access to GoSouq, without notice where needed, if you breach these Terms, misuse the service or put other users or the service at risk.
The sections on content and trademarks, the disclaimer, the limitation of liability, indemnity, fees already due, governing law and the general terms continue to apply after your use of GoSouq ends.
General terms
Force majeure: we are not responsible for any failure or delay caused by events beyond our reasonable control, such as outages of internet or cloud providers, natural events or government action.
Assignment: you may not transfer these Terms without our written consent. We may transfer them, for example as part of a reorganisation or a sale of the business.
Severability and waiver: if a part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up.
Entire agreement: these Terms and the privacy policy, together with any offer or invoice for paid services, are the whole agreement between you and us about GoSouq.
Language: these Terms are available in English and Arabic. If the two versions differ, the English version prevails.
Notices: legal notices to us must be sent to connect@codecraftbase.com. We send notices to a showroom at the email address of its account.
Governing law and disputes
These Terms are governed by the laws of the Kingdom of Bahrain, without regard to its conflict of law rules. The competent courts of the Kingdom of Bahrain have exclusive jurisdiction over any dispute arising from or relating to these Terms.
If you are a consumer, the mandatory consumer protection laws of the country where you live may give you rights that these Terms cannot take away.
Changes to these terms
We may update these Terms. The version and effective date are shown at the top of this page. If we make a material change, we tell showrooms by email before it takes effect. If you keep using GoSouq after the effective date, the updated Terms apply.
